Contribution of separate property to a community property regime triggers capital gains or losses for Income Tax purposes

A query was raised regarding whether the gratuitous contribution of separate property to a community property regime constitutes a taxable change in assets for Income Tax purposes. The Directorate General for Taxes (DGT) ruled that it does, as ownership is attributed equally to each spouse, thereby resulting in the transfer of half of the asset.

The question raised

Whether the gratuitous contribution of certain separate assets to the community property regime implies the existence of an asset alteration for the contributing spouse, subject to taxation under Personal Income Tax.

The DGT's ruling

The contribution of a separate asset to the community property regime alters the composition of the contributor's assets. As ownership is attributed equally to each spouse, a transfer of the portion corresponding to the non-contributing spouse occurs. This generates a capital gain or loss for Personal Income Tax purposes on half of the asset, calculated according to the acquisition and transfer values of gratuitous transfers. However, capital losses resulting from gratuitous transfers via inter vivos acts or gifts shall not be taken into account.
