Capital gains or losses on shares are attributed to the beneficial owner, not necessarily the legal owner

A query was raised regarding who is liable for tax on gains or losses from the sale of shares held in the name of only one spouse within a community property regime. The DGT ruled that ownership is determined by the actual ownership of the assets rather than solely by what is recorded in bank registers.

The DGT's ruling

Las ganancias y pérdidas patrimoniales se atribuyen a los titulares de los bienes o derechos según las normas de titularidad jurídica. En el régimen de gananciales, la titularidad de los títulos depositados en un contrato de depósito puede ser de ambos cónyuges si se acredita que pertenecen a la sociedad de gananciales. La Administración valorará las pruebas aportadas para determinar si la propiedad corresponde a la sociedad de gananciales o a un solo cónyuge.
