Remuneration of an Iranian Embassy employee is taxable in Spain if they are a national or non-occasional resident

An employee of the Iranian Embassy in Madrid has requested clarification on the taxation of their monthly remuneration. The DGT has determined that, pursuant to the Vienna Convention and the Double Taxation Convention with Iran, taxation will depend on the individual's nationality and whether their residence in Spain is not solely for the purpose of providing such services.

The DGT's ruling

Si el consultante es residente fiscal en España, se aplica la normativa interna y los convenios internacionales. Según la Convención de Viena y el Acuerdo Hispano-iraní, los sueldos por servicios prestados a un Estado extranjero solo tributan en el Estado receptor si el empleado es nacional de dicho Estado o si su residencia no se adquirió únicamente para prestar esos servicios. Por tanto, si es nacional español o su residencia no es para el servicio de la Embajada, tributará exclusivamente en España.
