Incentives for introducing new mutualists taxed as capital gains

A body asks about the tax treatment of a payment made to mutualists for facilitating new memberships. Hacienda rules that, as a mere introduction without commission agent activity, the incentive is a capital gain for personal income tax and examines its deductibility under corporate tax.

The DGT's ruling

In Personal Income Tax (IRPF), the incentive does not constitute income from economic activity because the mutualist does not perform a commission agent role, but rather a simple act of presentation. Therefore, it is classified as a capital gain as it incorporates money into the assets, without being subject to withholding. In Corporate Income Tax, the expense could be deductible if it is intended to promote the sale of goods or services, provided it meets the requirements of accounting registration, accrual, and substantiation.
