Refund of contributions is non-taxable; late payment interest is treated as a capital gain in the savings tax base

A member of a housing cooperative has requested clarification on the taxation of the refund of their contributions and legal interest following a court ruling. The Directorate General for Taxes (DGT) has ruled that the refund itself does not generate a gain or loss, whereas the interest constitutes a capital gain that must be taxed within the savings tax base.

The question raised

The DGT's ruling
