Possible deferment of VAT payment on imports under Regulation article 74

A co-operative society asks about the application of the passive party's investment in imports and how to declare them. The DGT clarifies that the passive party's investment does not apply to imports, but a payment deferment regime allows including the amount in the monthly declaration and settlement.

The question raised

Application of the reverse charge mechanism in relation to the import described and the method of declaring said operation for Value Added Tax purposes.

The DGT's ruling

The importer may choose between paying the VAT at the time of customs clearance or applying the payment deferral scheme if the requirements of Article 74 of the Regulation are met. If the deferral is chosen, the amount must be included in the tax return for the period in which the clearance document is received, using box 77 of Form 303. When doing so, the amount is recorded both as input VAT and output VAT, similar to the reverse charge mechanism.
