Exempt foreign exchange transactions may require invoicing and the maintenance of a received invoices register

A currency exchange entity has requested clarification regarding its formal obligations for transactions involving persons within and outside the EU. The DGT clarifies when invoices must be issued and how accounting registers must be maintained.

The question raised

Formal obligations derived from these operations.

The DGT's ruling

If foreign exchange transactions are deemed to be carried out within the national territory, there is an obligation to issue an invoice to the recipient. Regarding the accounting records, it is not necessary to maintain the register of issued invoices if there is no obligation to issue them, but it is necessary to maintain the register of received invoices, regardless of whether the activity is exempt and does not grant a right to deduction. The maintenance of records shall be carried out via the Electronic Office if the settlement period coincides with the calendar month.
