Grants for vacant places are compensatory in nature and not subject to VAT

A commercial entity managing residential centres has requested a ruling on the VAT treatment of two types of regional grants: a monthly increase per beneficiary and a payment for maintaining vacant places due to the pandemic. The DGT has determined that the increase per beneficiary forms part of the consideration subject to VAT, whereas the payment for vacant places is a compensation payment not subject to the tax.

The DGT's ruling

El incremento mensual por cada beneficiario constituye parte de la contraprestación por los servicios de residencia y está sujeto al IVA al formar parte de la base imponible. Por el contrario, el importe satisfecho en función de las plazas libres disponibles tiene naturaleza indemnizatoria, no constituye contraprestación de operación alguna ni subvención vinculada al precio, por lo que no está sujeto al IVA.
