Renting out your main residence results in the loss of the acquisition tax deduction

A taxpayer inquired whether renting out their main residence for short periods would result in the loss of the tax deduction for its acquisition. The Directorate General for Taxes (DGT) ruled that renting the property causes it to lose its status as a main residence, thereby eliminating the right to the deduction.

The DGT's ruling

La vivienda habitual requiere residencia continuada durante al menos tres años con uso efectivo y permanente. Al arrendar la vivienda, se pierde el carácter de habitual y el derecho a la deducción por adquisición. Para recuperar la deducción, la vivienda debe volver a ser residencia habitual con intención de habitarla permanentemente por tres años.
