Assignment of a NIF with a specific code does not determine legal nature for tax compliance purposes

A taxpayer queried the implications of the Tax Agency (AEAT) assigning a NIF with a code that differs from their actual legal form. The Directorate General for Taxes (DGT) ruled that while the entity must identify itself using the assigned NIF, this does not prevent the Administration from enforcing obligations based on the true legal nature of the facts.

The DGT's ruling

La entidad debe identificarse con el NIF asignado por la AEAT en sus relaciones tributarias. Sin embargo, la asignación de un NIF con una clave específica no excluye que la Administración aplique el artículo 13 de la LGT, exigiendo las obligaciones tributarias según la naturaleza jurídica real del hecho o negocio, independientemente de la denominación o defectos de la asignación.
