Maternity tax deduction and benefit exemptions applicable when contributing to a foreign public social security system

A tax resident in Spain working for a British company and contributing to the UK Social Security system has enquired whether they can claim the maternity tax deduction and if their maternity benefits are exempt from tax. The Directorate General for Taxes (DGT) has ruled that they can, provided the requirements of the Personal Income Tax Act (LIRPF) are met and the foreign system is an equivalent public scheme.

The DGT's ruling

Las referencias a la Seguridad Social en la LIRPF deben entenderse como sistemas públicos equivalentes extranjeros. Por tanto, una madre que cotice en un sistema público análogo al español cumple los requisitos para la deducción por maternidad. Asimismo, las prestaciones públicas por maternidad o paternidad percibidas de un sistema público extranjero están exentas de IRPF según el artículo 7.h) de la LIRPF.
