Audiovisual production deduction capped at actual incurred costs

An audiovisual producer asks how final production costs below initial budgets affect the deduction. The DGT states the deduction will be based on the actual production costs incurred.

The question raised

1. If, once the corresponding financing contract specifying the production budget has been submitted to the Tax Administration, the amount of the final expenses of such production is lower due to the impossibility of covering all those initially budgeted, does the taxpayer making the contribution lose the right to claim a deduction on the amounts effectively contributed, and is such deduction proportionally reduced in relation to the new justified amount of the production?

The DGT's ruling

The basis for the deduction consists of the total production cost and the expenses for copies, advertising, and promotion. If the final expenses are lower than those budgeted, the actual amount of the deduction generated by the producer shall be the one that determines the maximum deduction limit that the financier may apply (1.20 times their contribution). To apply the deduction, the financier must submit the financing contract and the certification before the end of the tax period to which they are entitled.
