Tobacco producers and buyers: mandatory use of approved standard contract for the 2026/2027 campaign

Order APA/1146/2026 approves the standard contract for tobacco cultivation and sale to be applied during the 2026/2027 campaign (2026 harvest). This contract establishes mandatory conditions for contractual relationships within the sector, regulating aspects such as selection by leaf tiers, product quality, and price revision mechanisms (Art. 1). The regulation is based on Law 2/2000 on standard contracts for agri-food products.

In 3 key points

  1. The buyer may reject the entire batch if the volume of foreign matter exceeds 15%, Art. 8 (art. Octava)
  2. The approval is valid for one year from the day following its publication in the BOE, Art. 2 (art. Segundo)
  3. Obligation to select tobacco by leaf tiers to guarantee quality, Art. 7 (art. Séptima)

How it affects those involved

For sellers (producers), the contract imposes strict obligations regarding quality, cleanliness, and mandatory selection by leaf tiers, allowing the buyer to reject batches if the volume of foreign matter exceeds 15% (Art. 8). For buyers, it establishes the obligation to pay according to the quality grade and the possibility of upward price revisions before deliveries begin (Art. 9). This contractual model is valid for one year from the day following its publication (Art. 2).
