Olive oil sector: potential product withdrawal and non-food use to stabilise the 2026/2027 market

Order APA/1145/2026 establishes marketing rules for the 2026/2027 campaign due to an expected olive oil oversupply resulting from an above-average harvest. The regulation allows for product withdrawal until the following campaign and/or diversion to non-food use, provided that market stabilisation is deemed necessary (preamble). The effective implementation and withdrawal percentages will be determined by resolution no later than 15 November 2026.

In 3 key points

  1. The start date and withdrawal percentage will be set by resolution no later than 15 November 2026 (art. 9)
  2. Entry into force on the day following its publication in the BOE (disp. final segunda)
  3. The applicable sanctioning regime is that of Law 30/2022 regarding olive oil marketing (art. 12)

How it affects those involved

For olive oil producers and marketers, the regulation introduces the possibility of the Ministry ordering the withdrawal of stocks or their diversion to non-food uses to prevent price destabilisation (preamble). Autonomous communities are responsible for conducting official controls to ensure compliance (Art. 10). Non-compliance with these marketing measures will be sanctioned in accordance with the regime established in Law 30/2022 (Art. 12).
