Provincial Directorates of SEPE: authority to resolve expulsion of participants in TándEM programs

This resolution modifies the 2008 delegation of competencies to adapt the management of active employment policies to the new TándEM programs (RD 1248/2024). It expressly grants Provincial Directorates the authority to resolve expulsion procedures for participants in the training stage of these experiential programs (art. Primero.Uno). The resolution must be reasoned and follow the procedure of hearing the interested party and the proposal from the promoting entity (art. Primero.Uno).

In 3 key points

  1. Provincial Directorates resolve expulsions in TándEM programmes within their territorial scope, Art. 1.1 (art. Primero.Uno)
  2. The expulsion resolution requires a proposal from the promoting entity and a hearing for the interested party, Art. 1.1 (art. Primero.Uno)
  3. Entry into force on the day of its publication in the BOE, Art. 2 (art. Segundo)

How it affects those involved

For participants in TándEM employment and training programmes, the decision regarding expulsion will be made directly by the Provincial Directorate responsible for the programme's territorial area (Art. 1.1). The entities promoting these programmes must submit a proposal for expulsion for the administration to resolve (Art. 1.1). The administration must guarantee the interested party's right to a hearing before issuing the resolution (Art. 1.1).
