Persons with disabilities and dependency: new measures for autonomy, digital inclusion, and home care services

Law 4/2026 modifies the Consolidated Text of the General Law on the rights of persons with disabilities and the Law on the Promotion of Personal Autonomy to strengthen autonomy and social inclusion. The law introduces digital skills acquisition as a new service and allows for the collective, coordinated, and shared organization of home care services for groups of people in community settings. These modifications respond to the mandate of Article 49 of the Spanish Constitution following its reform in February 2024.

In 2 key points

  1. Inclusion of digital skills acquisition as a new service in the catalogue of benefits. (Preámbulo I)
  2. Possibility of organising home care services in a collective, coordinated, and shared manner for small groups. (Preámbulo I)

How it affects those involved

For people with disabilities, a greater focus on human rights is guaranteed, and inclusion is facilitated through the strengthening of digital skills. People in situations of dependency gain flexibility with the new collective home care modality, which allows for coordinated services between neighbours or nearby individuals. Home care service providers and assistants are affected by the need to adapt to shared and community-based organisational models.
