The Resolution of 16 January 2026 revises the off-peak consumption requirement for eligibility as an electro-intensive consumer. It establishes that at least 46% of energy must be consumed during off-peak periods for at least two of the three preceding years (art. 3.2.b of Royal Decree 1106/2020). This requirement applies as a condition for accessing the category, following the temporary suspension of compliance during the cost adjustment mechanism provided for in Royal Decree-Law 10/2022 (fourth transitional provision).
Electricity consumers wishing to qualify as electro-intensive consumers must verify their off-peak consumption, as at least 46% of annual consumption during that period is now required for two of the three previous years. Companies and individuals with high energy demand must review their consumption records to meet the new threshold. Energy advisors must update their recommendations and verifications for clients applying for this category.
