Royal Decree 731/2026 regulates the Strategic Investment Committee and establishes the procedure for declaring Strategic Investment Projects. The evaluation process is divided into two phases: an initial phase based on quantitative aspects (investment volume and employment) and qualitative aspects (robustness and strategic suitability), and a second phase to assess socio-economic effects, environmental impact, and strategic autonomy. The final decision on the declaration is made by the Government Delegated Commission for Economic Affairs, upon the proposal of the Strategic Investment Committee.
For companies and project developers in key sectors (energy transition, semiconductors, biotechnology, etc.), the regulation provides a pathway to obtain Strategic Project status, enabling access to potential support measures. However, developers bear the risk of the declaration and associated aid being revoked if they fail to meet the obligations or commitments undertaken during the process. The Committee's Technical Secretariat has the authority to request additional information regarding economic and technical solvency to validate the project's viability.
