State and Generalitat suspend competition disputes on Decree-Law 14/2025 after approval of Law 3/2026

The Bilateral Commission for Administrative Cooperation between the State and Generalitat has agreed to refer competitive discrepancies regarding Decree-Law 14/2025 to future negotiations. This agreement arises because the new Generalitat Law 3/2026 explicitly derogates Decree-Law 14/2025 (art. I). The agreement is communicated to the Constitutional Court in accordance with Law 2/1979 (art. II).

In 2 key points

  1. Explicit derogation of Decree-Law 14/2025 by the sole derogatory provision 1.c) of Law 3/2026 (art. I)
  2. Communication of the agreement to the Constitutional Court pursuant to art. 33.2 of LO 2/1979 (art. II)

How it affects those involved

For businesses and citizens affected by the Valencian Generalitat's regulations, the competitive dispute over Decree-Law 14/2025 is now subject to the new framework of Law 3/2026. The State Administration and the Generalitat have ceased litigation on articles 23, 25, 26, 42, 45, 83 and the second transitional provision of the derogated decree (art. I). The practical effect is the replacement of the disputed regulatory framework with Law 3/2026.
