Adjacent owners: 30-day period to object to rectification of property description

The resolution denies the registration of an alternative georeferenced graphic representation of a property due to an objection from an adjacent owner, in accordance with Article 199.2 of the Mortgage Law. This procedure requires the adjacent owner to submit their objection within 30 days of the notification of the application (Art. 199.2). Previously, there was no clear timeframe for objections, which caused uncertainty in the rectification process.

In 1 key point

  1. Adjacent owners must object within 30 days to prevent rectification (art. 199.2)

How it affects those involved

Adjacent owners must act within 30 days of notification to object; otherwise, the rectification of the property description will proceed.
