Startups and new companies can access Reinicia+ FAIIP DANA funding
The Secretary of State for Industry has published a resolution (BOE-A-2026-22210) modifying the conditions of the Reinicia+ FAIIP DANA mechanism, which provides financing to companies located in areas affected by the DANA weather events of October and November 2024. This modification, approved by the Council of Ministers on October 6, 2026, aims to remove significant barriers that prevented newly established industrial projects from accessing recovery funds.
What changes
The most significant change introduced by this resolution is the removal of the requirement for a minimum period of three years of prior activity. Previously, this rule acted as a barrier for young companies or those undergoing structural reconfiguration due to the damage caused by the DANA events. According to the new text, no minimum period of prior activity development will be required for eligibility (Exposición).
Furthermore, the regulation provides a more flexible interpretation of the National Classification of Economic Activities (CNAE). While the core focus remains on industrial divisions 10 to 32, the new rules explicitly include:
- Industrial-scale valorization activities.
- Activities complementary to industrial production.
- Industrial services.
- Agri-food sector activities carried out in industrial facilities.
- Emerging sectors such as the circular economy and advanced services to industry.
Context
This resolution modifies the Annex I of the Resolution of January 22, 2025 (BOE-A-2025-1627), which originally established the conditions for the Reinicia+ FAIIP DANA mechanism. The modification is made in accordance with Royal Decree-Law 8/2024, of November 28 (BOE-A-2024-24840), which provides the legal framework for disaster relief and economic reactivation.
The adjustment also seeks to correct an asymmetry between this specific mechanism and the standard FAIIP instrument. In the ordinary FAIIP, no minimum activity seniority is required; by removing this requirement here, the government ensures consistency across all industrial policy instruments. Additionally, the measure complies with EU Regulation 651/2014, which does not impose minimum activity periods for regional investment aid, thereby aligning Spanish national measures with European guidelines.
Who is affected and how
Startups and newly created companies: This group is the primary beneficiary of this change. Previously excluded due to their lack of seniority, these entities can now apply for financing provided they present viable industrial projects in the affected zones. The removal of the three-year rule allows for immediate reconstruction or the establishment of new industrial initiatives to replace lost capacity.
SMEs (Small and Medium Enterprises): Existing SMEs in the affected areas gain greater flexibility. The broader interpretation of CNAE codes means that SMEs involved in circular economy or advanced industrial services, which might have previously struggled to fit into strict industrial definitions, can now access the funds. However, they must still demonstrate economic and technical viability as per the FAIIP Manual.
Large Companies: Large enterprises located in the affected zones remain eligible, provided they meet the general eligibility criteria of the FAIIP and comply with the specific requirements of the Reinicia+ mechanism. The focus for larger entities remains on significant industrial investment that contributes to the regional recovery.
Self-employed workers (Autónomos): Access for self-employed individuals is subject to consultation and specific criteria. To qualify, they must be able to prove they are conducting industrial activities or providing advanced services to the industry. They must also ensure they are not in a state of crisis or insolvency.
Strict Exclusions: It is critical to note that certain entities are strictly prohibited from receiving these funds regardless of their activity. According to section 5 of the Annex, companies cannot be beneficiaries if they:
- Are not up to date with any reimbursement obligations for previous State loans or advances.
- Are subject to a pending recovery order from a European Commission decision regarding illegal state aid.
- Are in a state of crisis as defined by EU Regulation 651/2014.
- Have been sanctioned with a firm resolution losing the right to public subsidies.
- Are in insolvency proceedings, have declared voluntary bankruptcy, or are under judicial intervention.
What to do and when
This regulation does not establish a generic deadline for all companies, but it does impose specific requirements that must be met at the time of application. If your company is considering applying for the Reinicia+ FAIIP DANA financing, you should follow these steps:
- Verify Investment Location: Ensure that the investment has not been relocated from the affected establishment in the two years prior to the application, and commit to not relocating it for two years after the investment is completed (apartado 5).
- Technical and Economic Assessment: Prepare documentation to prove the economic and technical viability of the project, following the guidelines established in the FAIIP Management Manual (apartado 6).
- Compliance Audit: Conduct an internal audit to ensure the company has no outstanding debts with the State and is not in any form of legal crisis or insolvency, as these are absolute bars to eligibility (apartado 5).
- CNAE Verification: Confirm that the activity, even if it falls under services or circular economy, meets the expanded definition of industrial activity provided in the new resolution.
