Regulated companies and sectors: CNMC strengthens economic and data analysis capabilities with the creation of Chief Economist role

Royal Decree 825/2026 amends the CNMC's Organic Statute to introduce the role of Chief Economist, reporting directly to the Presidency. This new position aims to provide the Commission with specialised and cross-cutting economic advice, particularly regarding competition law and regulation (Art. 31 ter). Additionally, the Economic Intelligence Sub-directorate is established to develop quantitative analysis tools, artificial intelligence, and data processing capabilities (Art. 31 ter.1).

In 3 key points

  1. Creation of the Chief Economist role to provide specialised and cross-cutting economic advice (art. 31 ter)
  2. The Economic Intelligence Sub-directorate will develop AI and quantitative analysis tools (art. 31 ter.2.a, c)
  3. Entry into force on the day following its publication in the BOE, Art. 16 of October 2026 (disposición final única)

How it affects those involved

For companies and economic operators subject to CNMC supervision, the regulation implies an enhancement of the authority's technical capacity to investigate anti-competitive conduct through the use of artificial intelligence and big data analysis (Art. 31 ter.2.a, c). The creation of the Economic Intelligence Sub-directorate strengthens the ability to detect infringements using business intelligence tools (Art. 31 ter.2.a). Public administrations and regulated sectors will face more technologically sophisticated supervision.
