Candidates and representatives: 48 hours to challenge irregularities in councilor appointment

The Resolution of March 23, 2026, announces the appointment of a councilor in Fuente Palmera (Córdoba) due to vacancy, in accordance with article 182.2 of the LOREG and Instruction 1/2025. Representatives of candidacies have two days to challenge irregularities after publication in the BOE. This mechanism allows replacement of local representative positions in cases of vacancy with no remaining candidates (art. 182.2 LOREG, Instruction 1/2025, no. 2, paragraph 2).

In 2 key points

  1. Candidates' representatives have 48 hours to file complaints about irregularities after publication (art. 182.2 LOREG, Instrucción 1/2025, n.º 2 apartado 2)
  2. The appointment is made by vacancy and absence of candidates on the list (art. 182.2 LOREG)

How it affects those involved

Candidates' representatives can file complaints about irregularities within 48 hours of publication, directly affecting political parties and coalitions. Municipal administrations and local councils must monitor such complaints to determine whether new elections or candidate replacements are necessary. Political advisors must inform their clients about the time limit and content of the complaint. This process does not affect ordinary citizens or businesses.
