Suppression of additional provision 2 and reference in article 5.a) of public sanitation collective agreement

The February 6, 2026 Resolution removes additional provision 2 and the referenced clause in article 5.a) of the public sanitation collective agreement, published on October 15, 2026, in accordance with articles 90.2 and 90.3 of the Workers' Statute and Royal Decree 713/2010 of May 28.

In 2 key points

  1. The additional provision 2 and the relevant provisions of article 5.a) of the Public Sanitation Convention are abolished (disposición adicional 2 y lo indicado del art. 5.a) del Convenio publicado por Resolución de 15 de octubre de 2026)
  2. The abolition is based on articles 90.2 and 90.3 of the Workers' Statute Law (art. 90.2 y 3, de la Ley del Estatuto de los Trabajadores)

How it affects those involved

Workers and businesses in the public sanitation sector lose the previous regulatory reference concerning article 5.a) and its additional provision, which may lead to uncertainty regarding the interpretation of their labour rights and obligations. Public authorities and trade union representatives must update their procedures and communicate the change to affected staff. Labour advisors should review their guidance on working conditions in this sector.
