Nuclear facility licensees: must ensure nuclear safety and radiological protection throughout decommissioning

Instruction IS-49 establishes the technical criteria and safety requirements for the decommissioning of nuclear facilities and associated radiological protection. The regulation governs the licensee's obligation to maintain safety conditions through a graded approach based on radiological risk (Art. 3) and the requirement for an organisational structure with a clear hierarchy and safety culture (Art. 4.1). Furthermore, it complements the Regulation on Nuclear and Radioactive Installations (RINR) approved by Royal Decree 1217/2024.

In 3 key points

  1. Obligation to maintain nuclear safety and radiological protection conditions throughout the entire process, Art. 3 (art. 3)
  2. Requirement for an organisational structure with a clear hierarchical line and unambiguous reporting lines, Art. 4.1 (art. 4.1)
  3. Duty to periodically evaluate the adequacy of the organisational structure in response to changes in risk, Art. 4.2 (art. 4.2)

How it affects those involved

For ENRESA, as the licensee of nuclear facilities and the party responsible for decommissioning as an essential public service, the regulation imposes the obligation to implement an organisational structure with unambiguous lines of command and the capacity to suspend unsafe activities (Art. 4.1). The licensee must conduct periodic evaluations of its structure to ensure emergency response capabilities and the maintenance of safety in the face of changes in risk (Art. 4.2).
