CNMC and AEPD sign cooperation agreement to supervise electronic communications and data access

The CNMC and the AEPD have signed a cooperation agreement to coordinate their actions regarding electronic communications and data protection. The agreement establishes mechanisms for mutual consultation on numbering retention and user rights (Art. III), as well as joint supervision of Regulation (EU) 2023/2854 on fair access to data (Art. IV). To this end, a joint Monitoring Commission will be established, consisting of three representatives from each agency (Third Clause).

In 3 key points

  1. Cooperation in the supervision of Regulation (EU) 2023/2854 on fair access to and use of data, Art. IV (art. IV)
  2. Creation of a joint Monitoring Commission with three representatives from the CNMC and three from the AEPD, Third Clause (Tercero)
  3. Possibility of mutual consultations regarding user rights and the provision of subscriber data, Art. III (art. III)

How it affects those involved

For telecommunications and digital services companies, this agreement implies coordinated supervision by two independent authorities, reducing the divergence of criteria on interoperability and data access issues (Art. IV). Operators will need to comply with both the CNMC and the AEPD in processes where market competition and privacy mandates overlap. The creation of a Monitoring Commission aims to resolve interpretation disputes internally between both bodies (Third Clause).
