Candidates' representatives have 48 hours to raise irregularities in municipal council member appointment

The June 22, 2026 Resolution announces Salvador Climent Bataller's appointment as councilor of Favara due to vacancy from the May 28, 2023 municipal elections. Representatives of political candidates have two days from publication in the BOE to raise irregularities that would prevent the appointment, in accordance with point 2 of paragraph 2 of Instruction 1/2025 (BOE 31, February 5). This mechanism allows interested parties to exercise oversight over the legitimacy of the appointment.

In 2 key points

  1. Candidates' representatives have 48 hours to file complaints of irregularities (número 2 del apartado segundo de la Instrucción 1/2025, de 30 de enero)
  2. The appointment is made by vacancy in the position of mayor of Favara (artículo 182.2 de la LOREG)

How it affects those involved

Candidates' representatives can file complaints of irregularities within 48 hours, directly affecting political parties and their representation structures. Local administrations must monitor such complaints to verify the legitimacy of appointments. Party advisors must inform their representatives about the time limit and content of the announcement so they can act promptly.
