Candidates' representatives have 48 hours to raise irregularities in councilor appointment

The June 9, 2026 Resolution announces the appointment of Antonio Frutos Martín as councilor in Higuera de la Serena due to vacancy from the May 28, 2023 municipal elections. Representatives of political parties may raise irregularities within two days of publication in the BOE, as provided in paragraph 2 of section 2 of Instruction 1/2025 (BOE 31, February 5). This mechanism enables a quick review of the legitimacy of the replacement process.

In 3 key points

  1. Candidates' representatives have 48 hours to report irregularities (plazo de dos días desde la publicación)
  2. The appointment is based on vacancy resulting from the 28 May 2023 elections (vacante en el cargo de concejal correspondiente a la candidatura del PSOE en las elecciones municipales de 28 de mayo de 2023)
  3. Application of point 2 of section two of Instruction 1/2025 (número 2 del apartado segundo de la Instrucción 1/2025, de 30 de enero)

How it affects those involved

Candidates' representatives have 48 hours to report irregularities, which directly affects their ability to respond to substitution processes. Local authorities must ensure transparency in the publication of the announcement. Party advisors must monitor the deadline and prepare complaints if there are doubts about the legitimacy of the process. Citizens can be kept informed but have no right to directly intervene.
